These Terms of Use and Conditions ("Terms") govern your use of the MXperience website and tour services. By accessing our website or booking our services, you agree to be bound by these Terms.

By using our website, making a booking, or participating in our tours, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of our services immediately.

3. Services Description

MXperience provides private, customized tour guide services in Mexico City and surrounding areas, including but not limited to:

  • Culinary experiences

  • Historical site visits

  • Archaeological excursions

  • Custom itinerary planning

  • Transportation coordination

  • Local expertise and guidance

All services are subject to availability and confirmation.

4. Booking and Reservations

4.1 Booking Process

​

  • All bookings must be confirmed in writing via email

  • A deposit is required to secure your reservation

  • Full payment is due according to the payment schedule provided

  • Bookings are confirmed only upon receipt of required payment

4.2 Pricing

​

  • All prices are quoted in USD or Mexican Pesos as specified

  • Prices include guide services as described in your itinerary

  • Additional costs (entrance fees, meals, transportation) are clearly itemized

  • Prices are subject to change until booking is confirmed with deposit

 

4.3 Payment Terms

  • Deposit: 30% required to confirm booking

  • Balance: Due 48 hours before tour date

  • Accepted Methods: Credit cards via Stripe, bank transfer, cash (in person)

  • Currency: Payments accepted in USD or Mexican Pesos

5. Cancellation and Refund Policy

5.1 Client Cancellations

  • More than 7 days before tour: Full refund minus 10% processing fee

  • 3-7 days before tour:  50% refund of total payment

  • Less than 3 days before tour: No refund (deposit and balance forfeited)

  • Same day cancellation: No refund

5.2 MXperience Cancellations

If we must cancel due to circumstances beyond our control:

  • Full refund of all payments made

  • Alternative dates offered when possible

  • No liability for additional expenses incurred

5.3 Weather and Force Majeure

  • Tours may be modified due to weather conditions

  • Indoor alternatives will be provided when possible

  • No refunds for weather-related modifications

  • Force majeure events (natural disasters, civil unrest, government restrictions) may result in cancellation with full refund

6. Tour Participation Requirements

6.1 Participant Eligibility

  • Participants must be able to walk for extended periods

  • Medical conditions that may affect participation must be disclosed

  • Minors must be accompanied by adults

  • Participants must follow guide instructions for safety

 

6.2 Health and Safety

  • Participants join tours at their own risk

  • Pre-existing medical conditions must be disclosed during booking

  • Travel insurance is strongly recommended

  • Participants must follow local laws and customs

6.3 Behavior Standards

We reserve the right to terminate services without refund if participants:

  • Engage in illegal activities

  • Show disrespectful behavior toward guides or locals

  • Endanger themselves or others

  • Fail to follow reasonable safety instructions

 

7. Liability and Insurance

7.1 Limitation of Liability

MXperience's liability is limited to the amount paid for services. We are not responsible for:

  • Personal injury or property damage

  • Theft or loss of personal belongings

  • Delays or changes to third-party services

  • Acts of nature, civil unrest, or government actions

  • Medical emergencies or pre-existing conditions

 

7.2 Participant Responsibility

Participants acknowledge and agree that:

  • They participate in tours voluntarily and at their own risk

  • They are responsible for their personal safety and belongings

  • They have adequate travel and health insurance

  • They are physically and mentally capable of tour participation

 

7.3 Indemnification

Participants agree to indemnify and hold harmless MXperience, its guides, and partners from any claims, damages, or expenses arising from their participation in tours.

8. Intellectual Property Rights

8.1 Website Content

All website content, including text, images, logos, and design, is owned by MXperience and protected by copyright laws. Unauthorized use is prohibited.

8.2 Photography and Media

  • We may take photographs/videos during tours for marketing purposes

  • Participants consent to use of their likeness in promotional materials

  • Participants may opt-out by informing the guide at tour start

  • Participants retain rights to their own photographs

9. Privacy and Data Protection

Your personal information is handled according to our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to data collection and processing as described in our Privacy Policy.

10. Third-Party Services

We may arrange third-party services including:

  • Restaurant reservations

  • Transportation

We are not responsible for third-party service quality, cancellations, or issues. Complaints should be directed to the service provider.

These Terms are governed by Mexican law. Any disputes will be resolved in the competent courts of Mexico City, Mexico. For international clients, alternative dispute resolution may be available.

17. Quality Assurance

We are committed to providing excellent service. If you are unsatisfied with any aspect of your tour:

  • We will investigate and respond within 72 hours

  • Appropriate remedies will be offered when warranted

 

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any written tour confirmations, constitute the entire agreement between you and MXperience regarding our services.

20. Language

These Terms are written in English for the convenience of our international clients. In case of any legal proceedings in Mexico, Spanish translations may be required and will govern in case of discrepancy.
